Can a buyer subdivide one of these lots again?
Potentially, yes. Buying one of the proposed lots would not automatically prevent the new owner from subdividing it again.
Because the property is zoned FA (Forest Agriculture), every new lot would need:
- At least 1 acre
- At least 100 feet of width at the building line
- At least 50 feet of frontage on a street or approved shared access easement
- Approved water and sewer service, or sufficient land for a well and septic system
- A buildable area that meets setbacks and is not consumed by wetlands or the pond area
Any future division must be submitted to Georgetown County Planning before the new plat can be recorded. The county expressly applies this requirement to an owner who wants to divide or re-subdivide property.
Important for this particular tract
The county may consider later splits to be a continuation of the original subdivision when they occur within 10 years. A subdivision containing 10 or fewer resulting lots is generally treated as a minor subdivision, but expansion beyond 10 lots within 10 years can trigger major-subdivision infrastructure requirements.
So, theoretically by acreage alone:
- A 4.17-acre lot could contain up to four 1-acre lots
- A 4.31-acre lot could contain up to four
- A 3.91-acre lot could contain up to three
That is only an acreage calculation. Based on the shapes shown, frontage, access, wetlands, septic suitability, and the 100-foot width requirement would probably reduce the actual number.
If the seller does not want buyers subdividing further, the seller should record a deed restriction stating that each lot may not be further subdivided. Otherwise, FA zoning itself likely leaves that possibility open.
